New Jersey is reminding residents to be stringent when selecting wagering options as the US sporting scene prepares for the start of the NFL season later this week.

With the college football season getting underway on August 26 when Notre Dame triumphed 42-3 over Navy, its NFL counterpart will follow suit on Thursday (September 7) as the Super Bowl champions Kansas City Chiefs take to their Arrowhead Stadium home versus the Detroit Lions.

Subsequently, the Garden State’s Office of the Attorney General, Division of Gaming Enforcement, and Division of Consumer Affairs have reminded locals of the necessity of avoiding illegal entities when wagering, or engaging in fantasy sports, related to each.

“We know that the start of football season brings with it an uptick in sports betting and fantasy sports participation, and we want everyone to enjoy these activities safely and securely,” commented First Assistant Attorney General Lyndsay Ruotolo

“Sportsbooks and daily fantasy sites licensed and authorised to operate in New Jersey are subject to nation-leading consumer safeguards against fraud, identity theft, and unscrupulous actors; however, illegal sites have none of these protections. 

“This season, we urge fans to stick with regulated websites to avoid scams and bogus offers. And for those who may need help with a gambling problem, know that help is available.”

Using authorised operators, the aforementioned authorities warned, is the only way to ensure that business is being conducted under regulatory oversight and abiding by the laws that protect consumers against fraud, deceit, and other illegal conduct.

“The problems with illegal sportsbooks are numerous,” said DGE Director David Rebuck. “They lack oversight to ensure customers are actually paid what they won as well as security protocols to safeguard sensitive personal and financial information, like social security numbers and bank data.”

The state has also reminded consumers that unregulated, illegal sportsbooks and fantasy sports sites may lack operational and financial controls, proper and timely payment processing, dispute resolution processes, transparent ownership; and anti-money laundering controls.

In addition, a series of further warnings regarding illegal options have also been issued, with these including deposits and payments being accepted in crypto, offerings bets or unapproved political contests, charging fees for processing deposits or withdrawals, advertising bonuses and promotions that seem too good to be true and operating without .com or using a domain from outside the US.

“For many fantasy sports participants, the start of the football season is an especially exciting opportunity to test their knowledge of the players and the game by drafting and managing their own virtual team in fantasy football contests,” added Cari Fais, Acting Director of the Division of Consumer Affairs.

“Today we’re reminding these armchair managers that the most important pick of a winning season is selecting a fantasy sports operator that is properly permitted and doing business legally in New Jersey to ensure the game is fair and everyone is playing by the rules.”

Betting on certain professional and collegiate sports at casinos and racetracks was legalised in New Jersey in 2018 under the regulatory authority of DGE. It is not legal to bet on New Jersey college teams or on college games that take place in the state.

Finland is to transition to a licensing model by no later than January 1, 2026, bringing an end to the monopoly status held by Veikkaus in the country.

After years of rejecting recommendations to make such a shift, the country’s new government disclosed the plans as part of a multi-faceted programme that is designed to “build a strong and committed Finland”.

The New South Wales government delayed a proposed hike in casino tax rates on embattled Star Entertainment Group that was due to enter into force within the next two weeks.

As financial challenges hit the Australian state, as well as the casino group, the now deferred decision was initially detailed in December to raise an additional A$364m over the next three years.  

Despite being written into the budget by NSW’s previous government, the tax increase was legislated and inherited by the current incumbents as a legacy policy upon election in March.

Sweden is seeking to implement higher penalty fees for those that violate the country’s Money Laundering Act under fresh proposals tabled yesterday.

Liquor & Gaming NSW is stepping up a state-wide compliance initiative that is tasked with monitoring compliance with key gaming harm-minimisation measures.

After it was recently suggested that venue closures could commence across the region to combat EGM concerns, in the region of 500 inspections are to commence at pubs and clubs.

Under this second stage of the program, the liquor, wagering and gaming regulator has warned that a “zero-tolerance approach” to breaches will be taken”.

The initiative is to inspect the promotion of safer gambling cultures, protecting patrons and the wider communication for excessive gambling and the presence of associated signage across the facilities.

Kentucky has an “important opportunity” to adopt a legal, regulated sports betting market that will help fund “ critical initiatives” and give constituents “what they want,” according to Bill Miller, American Gaming Association President and CEO, in an open letter to members of the Senate.

The plea to the Bluegrass State comes amid a potential last minute scramble to nudge House Bill 551 over the line, with the Senate having the final two days of the session, which begin today (Wednesday 29 March), to act.

After having passed through the House of Representatives, a two-thirds majority, or 23 votes, is needed during the 48 hour period to trigger advancement to the desk of Governor Andy Beshear, who has repeatedly thrown his support behind a legalised ecosystem.

Miller has urged the state to join 36 states and the District of Columbia in adopting “ legal, regulated options to safely engage in sports betting rather than continue to rely on illegal channels”.

Adding that “legal sports betting enhances consumer protections and helps promote transparency while generating tax revenue for the state to invest in vital initiatives.”

Furthermore, Miller cited that six of seven bordering states already boast legalised options, which he suggested leaves citizens having to travel to a neighbouring region or access illegal offerings. 

To back up this point, Miller pointed to GeoComply data, which highlighted that more than 295,000 geolocation checks occurred in Kentucky during the opening weekend of the NCAA’s March Madness tournament

Data tracked by the geolocation company suggested that 40 per cent of the checks were for Ohio sportsbooks, with a further 39 per cent seeking Indiana sports wagering options.

“All the attempts were blocked,” Miller continued. “This consumer demand makes clear that the alternative to creating a legal marketplace is that Kentuckians will continue betting in the illegal market, with no consumer protections and no benefits generated for the state.”

In addition to detailing estimates of a $64bn a year illegal industry, Miller noted a potential diversity of operators that would not only deliver multiple options for locals, but also eliminate the chances of creating a controlling monopoly. 

This competitive environment would be created by the state authorising licensed horse tracks to partner with up to three online sports betting skins.

“A legal, regulated sports betting market provides consumers with a safe environment to responsibly wager, with operators using technology to track unusual betting patterns and protect game integrity, provide responsible gaming tools such as betting and time limit restrictions that users can impose, and age verification requirements to ensure minors are not placing wagers,” Miller commented.

Gaming Innovation Group has detailed plans for further North American expansion after receiving licences to enter both Pennsylvania and Maryland.

The former is courtesy of a full interactive gaming manufacturer certification, while entry into Maryland has been achieved courtesy of the receipt of an online sports wagering operator permit.

These latest North American moves, said GiG, complement an “established five year presence” via New Jersey and Iowa, in addition to “upcoming partnerships” in Ontario.

With the group’s current access spanning 30 more markets, GiG has noted that it has further imminent entries across “some of the most complex regulatory environments available” in the pipeline.

Further North American expansion is expected to come through the establishment of a fresh US-based hub, which is slated to come to fruition later this year.

“Having placed a strong focus on expansion in regulated markets, we’re understandably pleased with the confirmation of our licences in two new US states,” stated Claudio Caruana, General Counsel for GiG.

“Regulation will continue to drive the industry in North America, as markets mature, allowing us to support and protect operators and their customers, establishing suitable, robust frameworks for sustainable growth.”

The licence issued by the Maryland Lottery and Gaming Control Agency will initially see GiG power the launch of Crab Sports in the Old Line State this May.

November 2022 saw online gaming debut in the state, with 10 retail and eight mobile sportsbooks said to have produced a handle of $441.5m and GGR of $59.6m for January, according to Eilers & Krejcik.

Furthermore, following the Pennsylvania Gaming Control Board green-light, a planned Keystone State launch is “expected in due course” which it is said will expand a relationship with an existing partner in North America.

Marcel Elfersy, Chief Commercial Officer at GiG, added: “With our plans to open our new US hub later this year and having recently been shortlisted with EGR North America in the full-service platform provider of the year category, our new licensed status in these very attractive online markets creates further opportunity for us to add value for new and established partners in the region.

New Jersey’s gambling ecosystem has surpassed the $5bn barrier in revenue through the past year, and in the process has matched an all time high that was witnessed seventeen years ago.

The figure of $5.21m gained during 2022, which represents a ten per cent year-on-year uptick from $4.73bn, stands alongside a figure last seen in 2006. December’s figure increased 12.5 per cent YoY to $454.78m (2021: $404m).

The final month of the year witnessed increases across all reporting segments, as disclosed by the New Jersey Division of Gaming Enforcement, with online casinos and poker rooms up 13.7 per cent to $151.45m (2021: $133.21m).

Continuing the sense of familiarty within the Garden State, it’s Borgata that sits atop the tree during December with revenue of $43.7m, which is a rise of 18 per cent from the $37m recorded one year earlier.

Resorts Digital retained its silver placed status via an increase of 22.7 per cent to $40.39m (2021: $32.93m), with Golden Nugget Online Gaming once again not far behind with $37.78m, up 14.9 per cent from 2021’s $36m.

For the full-year, revenue across the region stood at $1.66bn (2021: $1.36m), with Borgata’s $496.27m (2021: $412.12m), ahead of GNOG’s $431.73m (2021: $378.6m) and the $393.31m (2021: $291m) recorded by Resorts.

According to filings received by the state regulator, total win across the nine casino hotel properties increased 1.8 percentage points to $215.6m (2021: $211.8m). For the year, this figure stands at $2.79bn, up nine per cent from the $2.55bn recorded one year earlier.

This aforementioned familiarity continued among the land-based venues, with Borgata on top with a 11.4 per cent rise to $60.48m (2021: $54.3m), ahead of Hard Rock’s $37.45m (2021: $35.53m) and Ocean Casino’s 11.3 per cent increase to $29.49m (2021: $36.49m).

For the year, the top three remain the same as Borgata secured a 19.5 per cent rise to $724.42m (2021: $606m), Hard Rock behind via a 14.2 per cent increase to $492.35m (2021: $432.12m) and Ocean Casino closing at $356.82m, up 16.3 per cent YoY from $306.83m.

Per casino vertical, slot machines recorded a revenue of $153.98m, a 2.3 per cent increase from $150.47m, while table games rose half a percentage point to $61.64m. For the year these figures stood at $2.04bn (2021: $1.87bn) and $741.7m (2021: $680m), respectively.

Elsewhere, the region’s sports wagering handle closed the month at $1.05bn, with online contributing $998.39m of that figure. Handle for the 12 month period is reported by the NJDGE as $10.94m, with the digital space occupying $10.14m of that figure.

The state’s sportsbooks gained $87.7m in December gross revenue, which is up 48.5 per cent YoY from $59m. However, total revenue across 2022 dropped 6.5 per cent to $762.95m (2021: $815.79m).

American Gaming Association’s CEO, Bill Miller, has emphasised that the AGA are ‘in for the long haul’ to protect consumers after a new report revealed worrying figures. 

Urging the sector to “work together” to fight against illegal and unregulated operators, Miller’s call to action comes after the AGA’s report uncovered that Americans are betting approximately $511bn a year with illegal igaming websites, unregulated machines and sportsbooks. 

Conducted by The Innovation Group on behalf of the AGA, the findings of the ‘Sizing the Illegal and Unregulated Gaming Markets in the US’ report noted that the use of these black market operators is currently costing the legal sector $44.2bn in gaming revenue and state governments $13.3bn in lost tax revenue. 

Breaking down the above figures, the report showed that Amercans wager an estimated $337.9bn with illegal igaming websites, with a loss of $3.9bn in state tax revenue. 

Furthermore, with $13.5bn in estimated revenue, the AGA states that the illegal igaming market in the US is nearly “three times the size” of the legal US sector, estimated to be $5bn in 2022. 

Commenting on the report findings, Miller stated: “All stakeholders – policymakers, law enforcement, regulators, legal businesses – must work together to root out the illegal and unregulated gambling market. 

“This is a fight we’re in for the long haul to protect consumers, support communities and defend the law-abiding members of our industry.”

The report, which surveyed 5,284 US adults examining their past-year gambling behaviours with both legal and illegal operators, also looked into unregulated gaming machines, including “skill machines”. 

It revealed that an estimated 580,651 unregulated machines were in operation throughout the US with 870,000 regulated machines in casinos and slot routes. This has resulted in 40 per cent of all gaming machines in North America being unlicensed.

Based on state regulatory data for similar machines, the operator win percentage on unregulated gambling machines is significantly higher than legal casino slot machines. 

During the past 12 months, slot machines in Nevada have a 7.16 per cent win rate, compared to a nearly 25 per cent estimated win rate for unregulated machines.

The report also states that 48 per cent of Americans have played slots or table games with an illegal online casino in the past year.

Survey respondents were asked to indicate how often in the past year they played slots or table games, their average budget when playing these types of games, and what percentage of their play occurred online, at a casino or at distributed locations (e.g., bars, fraternal halls, gas stations, etc.). 

Respondents were also asked about their brick-and-mortar slot and table game spend and legal online slot and table game spend in order to identify respondent tendency to over or under report their gambling spend.

Miller concluded: “Illegal and unregulated gambling is a scourge on our society, taking advantage of vulnerable consumers, skirting regulatory obligations and robbing communities of critical tax revenue for infrastructure, education, and more. 

“We have always known that the illegal and unregulated market is expansive, but this report illuminates just how pervasive it is.”
